TSP Pilot Legal Information

By subscribing to, visiting, or using TSPpilot.com, the TSP Pilot dashboard, emails, text messages, alerts, model allocations, calculators, articles, performance dashboards, or other member resources, you agree to these legal disclosures, terms, privacy disclosures, and SMS terms, as updated from time to time.

These terms are a legally binding agreement between you and JSR Consulting LLC d.b.a. TSP Pilot. If you do not agree, do not use the website, dashboard, paid membership, or communications.

The website and membership are offered only to users who are at least 18 years old or have reached the age of majority where they live.

TSP Pilot may update these legal disclosures, terms, privacy disclosures, SMS terms, checkout terms, offer terms, plan-specific terms, and other service terms from time to time. Updated terms are effective when posted on TSPpilot.com or in the dashboard unless a later effective date is stated or applicable law requires a different process.

For material changes, TSP Pilot may provide notice by email, dashboard notice, checkout notice, account notice, website notice, or another reasonable method when required by law or when TSP Pilot determines notice is appropriate. Your continued access to or use of the website, dashboard, membership, emails, text messages, alerts, model allocations, calculators, performance dashboards, or member resources after updated terms become effective means you accept the updated terms.

If you do not agree to updated terms, stop using TSP Pilot and cancel before your next renewal. Terms that applied when a dispute arose will generally govern that dispute unless applicable law allows or requires otherwise.

TSP Pilot is an independent commercial service. It is not affiliated with, endorsed by, sponsored by, or operated by the U.S. federal government, the Federal Retirement Thrift Investment Board, the Thrift Savings Plan, tsp.gov, any federal agency, or any employer.

TSP Pilot publishes general TSP-focused market commentary, model allocation updates, alerts, educational resources, calculators, and model performance information for a broad subscriber audience.

TSP Pilot does not manage your TSP account, does not access your TSP credentials, does not place trades or interfund transfers for you, does not have custody of member assets, and does not make investment changes on your behalf.

TSP Pilot is intended to operate as a bona fide financial publication and newsletter of general and regular circulation. TSP Pilot relies on the publisher and newsletter exclusion from the definition of investment adviser under the Investment Advisers Act for bona fide newspapers, news magazines, and business or financial publications of general and regular circulation.

Our publications are not tailored to any one subscriber's full financial situation, risk tolerance, tax status, income needs, age, employment status, family circumstances, account balance, contribution rate, withdrawal plans, or other personal facts.

No TSP Pilot content creates an investment advisory, fiduciary, brokerage, tax, legal, accounting, financial-planning, or client relationship. TSP Pilot does not represent that any content has been reviewed, approved, or endorsed by the SEC, any state securities regulator, TSP, or any government agency.

TSP Pilot content is provided for general informational and educational purposes only. It is not individualized investment advice, tax advice, legal advice, accounting advice, retirement-planning advice, or a recommendation that any particular person buy, sell, hold, rebalance, transfer, contribute to, withdraw from, or allocate assets in any specific way.

You are solely responsible for deciding whether and how to use any TSP Pilot information. Before acting, consider your own circumstances and review current TSP rules, transfer limits, contribution limits, withdrawal rules, tax rules, and any professional advice you receive.

Investing involves risk. TSP funds can gain or lose value, and allocations that appear conservative may still lose money. Diversification, model allocation changes, commentary, and alerts do not guarantee profits, avoid losses, reduce volatility, or meet any retirement goal.

TSP Pilot model performance is simulated model performance, not the actual performance of any individual subscriber account. Individual results will differ based on contribution timing, payroll processing, account balances, interfund-transfer timing, execution delays, transfer limits, withdrawals, loans, taxes, lifecycle fund use, mutual fund window use, missed alerts, personal choices, and other facts.

Unless a page says otherwise, model returns are calculated from TSP share-price data and TSP Pilot model allocation history. The model begins with a hypothetical starting value, applies allocation changes as of the first available TSP share-price date on or after the stated trade date, rebalances exactly to the model allocation, and shows cumulative percentage change for the displayed period.

Performance figures may be gross of taxes, account-specific costs, transaction timing effects, payroll timing, and other individual frictions. They may be revised if source data, calculation logic, imported allocation history, or clerical errors are corrected.

Past performance, backtested performance, model performance, hypothetical performance, and commentary are not guarantees or reliable indicators of future results. No performance calculation or presentation has been approved or reviewed by the SEC or any other regulator.

Membership pricing, billing interval, trial terms, promotional terms, taxes, and renewal timing are shown at checkout or in your account billing area. Unless clearly stated otherwise at checkout, memberships renew automatically at the stated cadence until canceled.

TSP Pilot may use Stripe, PayPal, or successor payment providers to process charges. Payment providers, not TSP Pilot, handle full payment-card numbers. You authorize TSP Pilot and its payment providers to charge the payment method on file for recurring membership fees, applicable taxes, and any plan changes you approve.

If a payment fails, TSP Pilot or its payment provider may retry the charge, use payment-method updater services where available, ask you to update payment information, suspend access, or cancel access. Promotional, discounted, trial, paused, or retention offers renew or resume according to the offer terms shown when accepted.

TSP Pilot may change prices, plan names, plan features, or billing terms for future periods. Material price changes will be communicated as required by applicable law or payment-provider rules. If you do not accept a future price or term change, cancel before the next renewal.

Referral gifts are available only to eligible new TSP Pilot members and are limited to one referral gift per person and payment method. Referral gifts may not be used for self-referrals, duplicate or replacement accounts, or attempts to obtain additional free or promotional access.

TSP Pilot may deny, revoke, or terminate a referral gift or related promotional access if TSP Pilot reasonably determines that the offer was obtained through abuse, fraud, misuse, circumvention, or a violation of these terms.

Unless an offer expressly states otherwise, referral and promotional benefits have no cash value, are nontransferable, cannot be combined with other offers, and may be modified, suspended, or discontinued at any time, subject to applicable law.

Stripe-managed memberships must be canceled through the account billing area or Stripe billing portal. PayPal-managed memberships must be canceled through PayPal. Cancellation must be completed before the renewal charge is processed to avoid the next charge.

Email or support requests about cancellation are a courtesy support channel and may be subject to processing delays. Unless applicable law requires otherwise, an email request is not effective until TSP Pilot processes and confirms the cancellation or the cancellation is completed through the applicable billing portal or PayPal.

When cancellation is scheduled for a Stripe membership, the membership generally remains active through the current paid-through period and does not renew afterward. Paused billing or accepted retention offers may resume future billing automatically on the disclosed schedule unless you cancel or resume earlier.

Unless required by law or expressly promised in a written offer, charges are generally nonrefundable once a billing period begins. Canceling stops future renewals; it does not automatically refund the current billing period, unused time, promotional charges, annual charges, renewal charges, or partial months.

TSP Pilot may review duplicate charges, billing errors, failed-access issues, or exceptional circumstances case by case, but no refund is guaranteed unless required by law or specifically promised in writing.

TSP Pilot may modify, update, suspend, replace, remove, or discontinue any part of the website, dashboard, model allocation process, calculators, market commentary, alerts, notification channels, pricing, plan structure, or member resources at any time.

TSP Pilot may suspend or terminate access for nonpayment, chargebacks, abuse, fraud, security concerns, misuse of content, attempts to share or resell membership access, violation of these terms, legal or compliance concerns, or service discontinuation.

Member content is licensed for your personal use only. You may not copy, scrape, republish, redistribute, sell, sublicense, share login credentials for, or create a competing service from TSP Pilot content without written permission.

You are responsible for keeping your account credentials secure and for all activity under your account. Do not share account access, attempt to access another user's account, bypass access controls, or send TSP Pilot your TSP.gov username, password, security codes, or other government-account credentials.

You may not use TSP Pilot for unlawful, abusive, deceptive, infringing, security-compromising, or commercial resale purposes. You may not scrape, crawl, harvest, bulk download, reverse engineer, interfere with, overload, probe, or attempt to bypass technical protections for the website, dashboard, APIs, analytics, emails, SMS systems, or member content.

If you submit feedback, questions, support messages, testimonials, or other content to TSP Pilot, you represent that you have the right to submit it and you grant TSP Pilot permission to use it to operate, improve, support, market, and document the service, subject to applicable privacy obligations.

TSP Pilot depends on third-party services for hosting, authentication, databases, payments, email, SMS, analytics, customer support, security, and related operations. These providers may include Stripe, PayPal, Clerk, Supabase, Vercel, Resend, Twilio, Google Analytics, PostHog, Meta, and successor or similar providers.

Third-party services may have their own terms, privacy policies, processing rules, outages, delays, limitations, fees, disputes, chargeback processes, delivery failures, and support procedures. TSP Pilot is not responsible for third-party websites, services, payment processors, financial institutions, mobile carriers, email providers, analytics providers, or links outside TSP Pilot's control.

TSP Pilot may replace, add, remove, or change third-party providers when needed to operate, secure, measure, bill, communicate, or improve the service.

TSP Pilot collects information needed to operate the service, including contact details, account identifiers, membership status, billing status, notification preferences, support messages, SMS consent records, and usage activity.

When analytics are enabled, TSP Pilot may use Google Analytics, PostHog, Meta Pixel or Conversions API, and similar tools to understand traffic, product usage, signups, checkout activity, subscription events, retention events, and service performance. These tools may use cookies, device identifiers, IP address, browser or device information, page URLs, events, and account identifiers. PostHog may also be used for product analytics and, when enabled, session replay or similar diagnostic data.

Google requires sites using Google Analytics to disclose Google Analytics and how Google collects and processes data. Google's explanation is available at https://policies.google.com/technologies/partner-sites. PostHog states that customers are responsible for deciding what data they collect, complying with applicable privacy laws, and communicating collection to users.

TSP Pilot may share information with service providers that help operate the website and membership, including hosting, authentication, database, payment, email, SMS, support, analytics, security, and customer-service providers. TSP Pilot does not ask for or need your TSP login credentials, and you should not send them to us.

You can use browser controls, device controls, platform privacy settings, and supported provider opt-outs to limit some cookies or analytics. You may contact support@tsppilot.com for account, privacy, or data questions.

By opting in to SMS notifications, you agree to receive recurring automated text messages from TSP Pilot about account activity, member-only market commentary, allocation updates, and important service updates.

Consent to SMS notifications is not required to purchase a membership. Message frequency may be up to 4 messages per month. Message and data rates may apply.

Reply STOP to opt out or HELP for help. You can also manage SMS preferences from your account settings. Support can help with questions, but replying STOP is the one-step method to revoke SMS consent by text message.

TSP Pilot is provided on an as-is and as-available basis. To the fullest extent permitted by law, TSP Pilot disclaims all warranties, express or implied, including warranties of accuracy, completeness, timeliness, fitness for a particular purpose, merchantability, noninfringement, uninterrupted access, or error-free operation.

To the fullest extent permitted by law, TSP Pilot and its owners, officers, contractors, employees, agents, affiliates, service providers, and licensors will not be liable for investment losses, lost profits, lost savings, lost data, account losses, tax consequences, missed alerts, delays, interruptions, special damages, incidental damages, indirect damages, consequential damages, exemplary damages, punitive damages, or similar damages arising from use of or reliance on TSP Pilot.

To the fullest extent permitted by law, TSP Pilot's total liability for any claim relating to the service is limited to the amount you paid to TSP Pilot for the membership service during the 12 months before the event giving rise to the claim. Some jurisdictions do not allow certain warranty disclaimers or liability limits, so some limits may not apply to you.

You agree to defend, indemnify, and hold harmless JSR Consulting LLC d.b.a. TSP Pilot, its owners, officers, contractors, employees, agents, affiliates, service providers, and licensors from claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from your misuse of the service, violation of these terms, violation of law, infringement or misappropriation of third-party rights, credential sharing, unauthorized redistribution of content, or content you submit to TSP Pilot.

This indemnity does not require you to indemnify TSP Pilot for claims that applicable law does not allow to be indemnified.

To the fullest extent permitted by law, you and TSP Pilot agree that any dispute, claim, or controversy arising out of or relating to TSP Pilot, these terms, the website, dashboard, membership, payments, renewals, cancellations, refunds, communications, alerts, privacy practices, or any content or service will be resolved by binding individual arbitration, not in court, except for qualifying small-claims matters and requests for injunctive or equitable relief involving intellectual property, account misuse, security abuse, unauthorized access, or misuse of member content.

The Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement. Arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules or, if the AAA is unavailable, by a comparable neutral arbitration provider. The arbitrator may award the same individual remedies a court could award, but may not conduct a class, collective, consolidated, private-attorney-general, or representative proceeding unless applicable law requires otherwise.

Before starting arbitration, the party raising a dispute must send written notice describing the claim and requested relief to support@tsppilot.com and allow 30 days for informal resolution. You and TSP Pilot waive the right to a jury trial and waive the right to participate in class, collective, consolidated, private-attorney-general, or representative claims to the fullest extent permitted by law. If a court finds the class-action waiver unenforceable as to a particular claim, that claim must proceed in court and not arbitration.

These terms and any non-arbitrable dispute are governed by Delaware law, without regard to conflict-of-law rules, except that the Federal Arbitration Act governs arbitration. For disputes not subject to arbitration, you and TSP Pilot consent to exclusive jurisdiction and venue in the state or federal courts located in Delaware, unless applicable consumer law requires another forum.

If any part of these terms is found unenforceable, the remaining terms remain in effect to the fullest extent permitted by law. TSP Pilot may assign these terms in connection with a merger, acquisition, financing, restructuring, sale of assets, change of control, or transfer of the service. You may not assign your membership or these terms without written permission.

TSP Pilot's failure to enforce a term is not a waiver. These terms, together with checkout terms, offer terms, privacy disclosures, SMS terms, and any plan-specific terms shown to you, are the entire agreement for your use of TSP Pilot and replace prior or inconsistent understandings. Provisions that by their nature should survive termination will survive, including payment obligations, content restrictions, disclaimers, liability limits, arbitration, class-action waiver, governing law, indemnification, and ownership terms.

TSP Pilot is not liable for delay or failure caused by events outside its reasonable control, including acts of God, market closures, government action, war, terrorism, labor disputes, internet or carrier outages, cloud-provider outages, payment-provider failures, cyberattacks, security incidents, power failures, natural disasters, or other force-majeure events.
